Updated Mar 25, 2024Please read these terms very carefully and in their entirety. By purchasing my (Artist) services (Work), you (Client) automatically agree to the following conditions.GENERAL
The Artist reserves the right to:✧ Display the finished Work(s) in their portfolio and social media (unless the NDA fee is paid for).✧ Use, publish, livestream and record the Work process to share and promote on Patreon, Discord and other social media unless discussed otherwise.✧ Decline any project or client for any reason.✧ Retain full copyright to the Work unless discussed otherwise.✧ To sign and/or watermark the Work.✧ Sell pieces of commissioned fanart of existing IP/series/franchises, at any given point, such as prints, art books, etc.✧ Not work weekends, as deadline days are counted through business days only.✧ Refund Client the full amount paid if the Artist no longer wishes to continue working on Client’s project, for any reason.PAYMENTS
✦ The Artist is not responsible for any mistakes that are made by the Client over the course of the transaction.✦ The Artist does not accept payment from shared accounts unless the Client is not of legal age and uses a parent/guardian’s account.✦ If payment is not made in a timely manner, the commission will be canceled.✦ For Work under $250 USD: Full payment is required to start.✦ For Work above $250 USD: Payment may be split into installments, requiring a 35% deposit upfront.REVISIONS
Each commission type will have its own unique set of rules. Please make sure to read the details carefully on each commission page. Generally accepted are: 3 revisions per commission. Additional revisions will have extra charges and the price will vary depending on how big the revision is.✧ Skeb Style commissions will not allow any revision requests. The Client must submit all necessary details and will leave the rest to the Artist's freedom of creativity.DEADLINES, DELIVERY AND PRIVACY
✦ The Client must inform the Artist ahead of time if there is any delivery deadline or privacy request.✦ A rush fee of $50 USD may be applied if the commission deadline is within 15 days from when the proposal was made.✦ Delivery time may vary depending on the difficulty and/or type of commission.✦ The Client reserves the right to be notified of any delays.✦ No harassment over the Artist's work-speed will be tolerated, regardless of the time that has passed.✦ A flat fee of $200 USD will be charged when the Work is to be kept under NDA (fully private).✦ Due to health issues acquired during the COVID19 pandemic, the Artist may need extra time to complete the Work. Because of the nature of the Artist's health problems, at times a small break ranging from 2-3 days is enough; but some flare-ups can take weeks to heal. If this is the case, the Artist will reach out to the Client to discuss deadline extensions or even termination and refund of the project if absolutely necessary.✧ Skeb Style delivery time may vary.USE
✦ When reposting Work for SNS (such as icons, banners, etc.), make sure to credit the Artist properly.✦ The Client is responsible for saving any information, images, and other digital data provided once the Work is delivered.✦ If the Client wants to commission Work for commercial use, the total price of the commission, as well as royalties, will be agreed upon upfront. The minimum price increase is 100% of the original price (USD). However, the Artist reserves the right to charge more on a case by case basis.✦ The following cases are considered commercial use: Reproducing and selling the artwork, publicly or privately. Cases where you receive profit from a medium/platform where you have posted the Work, (e.g. Patreon, YouTube, Twitch, a personal site, business cards, etc.)STRICTLY FORBIDDEN USAGE:
✦ The Client shall not reproduce and/or otherwise use the Work in any manner for purposes of training machine learning/ generative artificial intelligence technologies to generate work, including without limitation, technologies that are capable of generating works in the same style or genre as the Work. Nor shall Client sublicense others to reproduce and/or otherwise use the Work in any manner for purposes of training machine learning/ generative artificial intelligence technologies to generate work.✦ The Work must not be passed off as made by the Client, nor be displayed anywhere that implies/claims that the work was made by Client.✦ The Client agrees to the policy of using the Work for personal, non-profit purposes only, unless otherwise stated.✦ NFT sales are strictly forbidden even if Client has paid for commercial usage.✦ The Client is not authorized to change, modify, edit or cut up Work without prior permission from the Artist.✦ Violators will be added to a personal blacklist indefinitely and without warning.INTELLECTUAL PROPERTY RIGHTS
✧ The Artist holds all rights to the Work.✧ All Work is delivered as digital products. Physical copies will not be provided for any commission currently being offered.REFUNDS AND CHARGEBACKS
The Client is required to contact the Artist when a commission cancellation is needed. If the Client decides to terminate working with the Artist at no fault by the Aritst:✦ If work has not yet started, full refund.✦ If the Work has been started but has yet to reach mid point, Artist keeps 25-50% of the commission price.✦ If the Work is past the middle point or close to completion, the Artist offers no refund.✦ Once Work is completed and delivered, the Artist offers no refund.✧ If the Artist fails to finish and deliver the Work due in any fault to the Artist themselves, the Artist will give a full refund.✧ For SKEB style commissions, there are no refunds unless the Work is not completed and delivered.✧ The Client is NOT authorized to issue a chargeback for any reason.✧ Purposefully issuing a chargeback without contacting the Artist first to cancel/refund a project will result in immediate blacklisting of the Client.COMMUNICATION
✧ Any comments that are rude, inappropriate, inflammatory, and/or non-constructive may result in blacklisting.✧ In the event of an emergency, the Artist will reach out to communicate with the Client as soon as able.Communication can be done via Vgen, Twitter, Discord or email depending on your preference.-------------Clients who have commissioned and/or received Work before this T.O.S. has gone into effect are still bound to its contents.-------------Please always feel free to message with questions!
